
Kuwait’s Public Authority for Manpower (PAM) has initiated a digital campaign to clarify the legal framework governing domestic employment. The initiative aims to foster mutual respect and ensure both sponsors and workers understand their protections under Law No. 68 of 2015.
Key Protections for Employers
- The Guarantee Period: If a worker leaves within the first six months, sponsors must contact the Domestic Workers Recruitment Department to secure their right to a refund.
- Contractual Transfers: Workers cannot be transferred to a new employer without PAM’s consent. Unauthorized transfers during the guarantee period result in a forfeiture of the recruitment guarantee.
- Conflict Resolution: If a worker refuses to perform their duties, they should not be returned directly to the agency. Employers must coordinate with PAM to investigate the cause and finalize legal procedures.
Key Rights for Domestic Workers
- End-of-Service Gratuity: Upon contract completion, workers are entitled to an indemnity payment equivalent to one month’s salary for every year of service.
- Communication & Privacy: Per the standard tripartite contract, workers have the right to own and use a mobile phone outside of working hours.
- Geographic Limits: Employers are prohibited from forcing staff to work outside of Kuwait without the worker’s explicit consent.
Compliance & Documentation
- Wage Transparency: Salaries must be documented via bank transfer or signed payment vouchers.
- Standard Contracts: All employment must utilize the PAM-approved recruitment contract to be legally valid.
- Repatriation: The employer is responsible for the costs of the worker’s return flight upon the expiration of the contract.
